Anyone holding a yard sale, garage sale or similar sale on residential property in the City of Fairview Heights is reminded that there is an ordinance requiring a permit for such activities and also that the city provides for the temporary usage of two signs to help with the promotion of these sales.
There is no fee for the yard sale permit or the use of the signs which are to be placed away from the premises where the sale is taking place. The signs, which come with a metal frame for sticking them into the ground, are made of a white styrofoam type of material and contain the words “Yard Sale” in large blue letters with a directional arrow underneath. Each sign given for a yard sale by the city also comes with a “topper” made of similar material upon which the address of the sale can be written. No more than two signs will be provided for each sale and they must be returned to the city hall during the next four working days after the sale is over. No yard sale for 3 consecutive calendar days; no more than 3 per year; no sooner than 30 days from the last sale.
These city-provided signs are the only types of signs allowed off the property of the sale. Homemade signs, generally made out of some type of cardboard, are only allowed on the property where the sale is held. All off-premises homemade yard sale signs put up in the city will be removed as permitted by ordinance by code enforcement personnel. The signs from the city may be placed upon any public right-of-way on the day or days of the sale. Public right-of-way is generally that area between the street or roadway pavement surface and where utility poles are placed along the roadside.
The ordinance covering such activities also includes tailgate sales, moving sales, or any type of sale of a similar nature at a residence. Businesses are covered by a separate and different set of regulations. Failure to comply could result in a citation which requires a court appearance. Refer to section
